When Congress passed the EB-5 Reform and Integrity Act in March 2022, most coverage focused on fraud protections and the regional center reauthorization. But by 2023, sophisticated investors had zeroed in on a different provision: the visa set-asides. The law reserved 20 percent of each year's EB-5 visas for investments in rural areas, 10 percent for high-unemployment areas, and 2 percent for infrastructure projects. Because these carve-outs were brand new, they had no backlog, and for investors born in India or China, staring at years-long queues in the standard EB-5 line, the rural set-aside became the fast lane to a green card.
Why set-asides changed the math
EB-5 allocates roughly 10,000 visas a year, subject to the same per-country limits that plague every category. Chinese investors had faced a long EB-5 queue for years, and Indian demand was building fast. The set-asides created three fresh sub-categories with their own visa allocations, each starting from zero demand. In Visa Bulletin terms, they opened "current" for all countries, meaning a Chinese or Indian investor filing in a set-aside category could proceed immediately rather than joining a queue that might run a decade or more. Pair that with the RIA's other gift, concurrent filing, and an investor already in the U.S. on H-1B or F-1 could file the investor petition and adjustment of status together, collecting a work permit and travel document within months.
Why rural beat the alternatives
Among the three set-asides, rural emerged as the favorite:
- The biggest allocation: 20 percent of visas versus 10 percent for high-unemployment areas, meaning more headroom before any backlog forms;
- Priority processing: the statute directs USCIS to prioritize rural petitions, and in practice some rural I-526E approvals came back remarkably fast, sometimes within a year;
- Cleaner qualification: a rural area is defined objectively (outside metropolitan statistical areas and towns over roughly 20,000), while high-unemployment designations involve census-tract math that invites gerrymandering games.
The result was a boom in rural project marketing: ski resorts, agricultural processing, rural hotels and infrastructure, packaged for investors at the standard roughly $800,000 targeted-investment level.
Credit where due, caution where needed
As policy, this is what intelligent legislating looks like, and it deserves saying plainly: Congress used the immigration code to steer foreign capital toward the small-town and rural America that global investment usually skips, and it did so with integrity measures, audits, and fund oversight attached. That is merit-and-market immigration policy, a straight trade of capital and jobs for residency, done by statute rather than memo.
But investors should hear the cautions just as plainly. "Set-aside" describes visa availability, not project quality; a bad deal in a beautiful cornfield is still a bad deal. Rural projects can carry weaker market fundamentals than urban ones, and job-creation projections deserve hard scrutiny. Set-aside availability is also not guaranteed forever: as demand piles into the new categories, backlogs can form, and analysts spent 2023 warning that heavy Chinese and Indian filings would eventually consume the headroom. Early filers captured the advantage; late filers may find the fast lane congested.
What this means for you
If you have roughly $800,000 in documentable, lawfully sourced funds and a long green card wait in your current category, the rural set-aside deserves a serious look, especially if you are in the U.S. and can file concurrently for adjustment, work authorization, and travel permission. Move deliberately but not slowly: set-aside headroom is a first-come resource. Diligence the project like the private investment it is, capital stack, exit strategy, developer track record, job cushion, and have independent counsel review both the securities documents and your source-of-funds evidence before wiring anything. And confirm the rural designation itself with current data, not marketing materials.
